Chinese Documents in a California Divorce: What to Translate

When one or both spouses have ties to China, a California divorce often involves Chinese documents: a marriage certificate, property records, bank statements, WeChat messages or an earlier Chinese divorce. This guide covers which documents tend to come up and how to get them translated. It is general information, not legal advice; your attorney decides what to file and exchange.

1. Documents that often come up

  • Marriage certificate (结婚证) and household register (户口本);
  • Property records: real estate certificates (房产证 / 不动产权证书) and purchase contracts;
  • Bank statements, and Alipay or WeChat Pay records;
  • Income records: pay slips, tax records, business licenses (营业执照) and company ownership records;
  • WeChat messages about money, property, children or agreements;
  • Earlier Chinese divorce documents: divorce certificate (离婚证), divorce agreement (离婚协议书), or court judgment or mediation statement (判决书 / 调解书).

2. Financial disclosure

In a California divorce each spouse must give the other a declaration of disclosure listing assets, debts, income and expenses (Family Code §2104; Judicial Council forms FL-140, FL-142 or FL-160, and FL-150). Property and accounts in China are part of that picture, and the supporting documents are often in Chinese.

3. Translations for court

A writing in another language offered as evidence is translated by a translator sworn to translate it truly (Evidence Code §§751, 753). For exhibits filed with motions, the California Rules of Court require an English translation certified under oath by a qualified interpreter (rule 3.1110(g)).

4. A previous divorce in China

If you were divorced in China before, keep the divorce certificate and, if you have it, the agreement or court judgment. These often come up again later: for example, a marriage-based immigration petition asks for proof that every earlier marriage legally ended, and USCIS needs full certified translations. Whether a Chinese divorce is recognized in a particular California case is a legal question for your attorney.

5. Keeping the cost under control

Long bank statements and chat histories add up. Ask your attorney which documents, and which pages, actually need translating before you order everything. Send sample pages first; we'll quote the full set once you know what's needed.
